The Better Way Back® is a program of NuVasive®, Inc. This Privacy Statement describes how NuVasive collects, uses, and shares the information that you or others provide to us as a result of your use of The Better Way Back products and services including participating as a patient or a Patient Ambassador in The Better Way Back Program (“the BWB Program”).

This Privacy Statement does not apply to NuVasive’s other products or services, which are governed by the NuVasive Privacy Policy. This Privacy Statement also does not address the privacy practices or policies of third parties with whom we may share your information as described in this policy, including Patient Ambassadors and medical professionals. Both our Patient Ambassadors and the medical professionals with whom we share your information, are independent from the BWB Program and are not otherwise affiliated with the BWB Program. As such, although we seek to ensure that Patient Ambassadors treat customer information confidentially and act in accordance with applicable law, we do not have control over and are not responsible for their practices with respect to the collection, use, and sharing of your information.

Please be sure to read this Privacy Statement before using NuVasive’s services or submitting information to us. This Privacy Statement is incorporated into The Better Way Back Participation Agreement, and your acceptance of the Participation Agreement constitutes your acceptance of the practices set out in this Privacy Statement. Your use of this web site and any information that you provide to us, including through registering for the program or participating in the program, is subject to this Privacy Statement and the Participation Agreement.

Collection of Information

Personal Information

NuVasive may collect personal information about you when you voluntarily provide us with such information, including when you register to participate in the BWB Program or volunteer as a Patient Ambassador. This information may include your name; contact information (such as your email address, home address, phone number, ZIP code, or state of residence); and other information about you (such as your gender, date of birth, and whether you have back pain or back surgery).
NuVasive may also collect information from you when you complete a patient survey, use our website to identify a surgeon in your area, use a Better Way Back wearable to monitor your activity level, or communicate with us by any means.

Non-Personal Information

NuVasive may also collect non-personal information about your visit to our website. Such information may include the time and date of your visit, your browser type and version, your IP address, the pages that you viewed, and your preference settings. We may use various technologies to collect this information, including cookies, eTags, web beacons, and log files.

We may use the non-personal information that we collect about you for our business purposes. These purposes may include automatically updating our web site, monitoring aggregate site usage metrics, improving the content on our web site, customizing our web site to your preferences, to monitor the web site for compliance with our Terms of Use and applicable law, for our marketing and research purposes, and for any other purpose specified at the point of collection.

Disclosure of Information

NuVasive may share both personal and non-personal information with affiliates, business partners, service providers, Patient Ambassadors, healthcare professionals (such as your surgeon), and other selected third parties as part of the services that we provide. We may also share personal information provided by Patient Ambassadors with a patient as part of the program. In addition, we may share both personal and non-personal information:

  • For third parties, such as healthcare professionals, to provide you with marketing information (see below for your choices regarding such sharing);
  • For research purposes;
  • As part of a sale, merger, assignment, or other transfer of all or part of The Better Way Back or any of its assets, affiliates, or products, including at bankruptcy;
  • To respond to law enforcement requests, subpoenas, or other legal process, or where we determine that disclosure is required by applicable laws, court orders, or government regulations;
  • To investigate, respond to or resolve problems or inquiries (including law enforcement requests) and to protect, enforce, or defend our rights, assets and/or interests, including pursuing any available remedies or to limit the damages that we may sustain;

The Better Way Back does not sell personal information for monetary or other valuable consideration. We do not use sensitive personal information for inferring characteristics about individuals. The Better Way Back does not use automated processing of personal information for profiling purposes.

You may, at any time, remove your personal information from our active records. To process your request, you must indicate on the subject line “Deactivation Request.” However, for our record keeping purposes, we will retain personal information you submitted for any previously completed contractual transactions. We may also retain other personal information in our archives.

We are unable to remove your personal information from the records of any third parties to whom we have already provided such information. If you wish to correct or delete any information maintained by a third party, please contact the third party directly.
